Nyako also adjourned the case of the IPOB leader to November 20th 2017 for trial. “He (Abaribe) cannot be discharged of his suretyship until he has produced the defendant or forfeit his bail bond. Only then can he be discharged,” the Judge said. Justice Binta Nyako gave Senator Abaribe three options. One of the options was for Abaribe to produce the defendant in court and then apply to be discharged as a surety. The other option the judge gave was for the lawmaker to be ready to forfeit his N100m bail bond. While the third option was for Abaribe to request to be given time to produce the defendant in court. The Senator had asked the court to discharge him from the suretyship, bond and recognizance of the bail of Nnamdi Kanu. The lawmaker prayed the court to discharge him entirely from the incidence of bail of Kanu. Kanu was absent from trial as co-defendants facing treason charges with him where in the court. The co-defendants were brought to court by prison officials at about 10am on Tuesday.
